The Electoral Commission is set up in terms of article 60 of the Constitution of Malta
and members of the Commission are appointed by the President acting in accordance with
the advice of the Prime Minister, given after he has consulted the Leader of the
Opposition. The Commission is an autonomous body and in the exercise of its functions
under the Constitution, it shall not be subject to the direction or control of any other
person or authority.
The functions of the Commission are the revision of the boundaries of
electoral divisions and the conduct of elections and referenda. The revision
of boundaries of electoral divisions shall be reviewed at intervals of not less
than two nor more than five years and may, in accordance with the provisions of the
Constitution, be altered to such an extent as the Commission considers desirable in the
light of the review.

The Commission is responsible for the compiling, maintaining and publishing the electoral
registers for a general election, Local Councils' elections and elections for the European
Parliament. The registers are published every six months during April and October and
are correct as on 31st March and 30th September respectively.
The Commission is also responsible for the Electoral Office. The Office
provides the administrative machinery and resources needed by the Commission
to fulfill its obligations according to law including the registration, transfer
and cancellation of voters and organisation of elections. The Head of the Electoral
Office is the Chief Electoral Commissioner who is also the Chairman of the Commission.
One of the functions of the Electoral Office is the issue of Identity Cards.
Although the Commissioner of Police is the authorised officer at law responsible
for the issue of Identity Cards, the Electoral Office on his behalf receives the
applications, processes the information and prints the ID Cards. The information
collected in connection with the ID Card serves also as the basis for the
compilation and updating of the electoral registers.
The Electoral Office has a section in Gozo where facilities are provided for the issue
and renewal of ID Cards and for any other information requested by persons residing there.
This section also serves as the focal point in Gozo whenever elections are held there.
